Applicable Law regarding International Child Abductions

There are a number of international, EU and Italian laws and regulations which govern this area.

1. The 1980 Hague Convention on the Civil Aspects of International Child Abduction (Concluded 25 October 1980). The Hague Convention of 25 October 1980 is a multilateral treaty, which seeks to protect children from the harmful effects of abduction and retention across international boundaries by providing a procedure to bring about their prompt return.

2. The European Council Regulation (EC) No. 2201/2003. This Regulation concerns jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000.

3. The Convention on the Rights of the Child, adopted and opened for signature, ratification and accession by General Assembly resolution 44/25 of 20 November 1989, entry into force 2 September 1990, in accordance with article 49.

4. The Italian Law n. 64, 15.01.1994. With this law Italy ratified the Hague Convention on the Civil Aspects of International Child Abduction and defined the procedure.
